3. User Responsibilities

3.1 Legal Ownership

You confirm that any vehicle you list is either:

• Owned by you outright, free of any finance agreements, or
• Subject to a finance agreement for which you have obtained express written permission from the lender to swap the vehicle

WARNING: Swapping a financed vehicle without lender authorization is a criminal offense under UK law and may constitute fraud.

3.2 Accurate Information

You must provide accurate, truthful, and complete information about your vehicle. Misrepresentation of vehicle condition, history, or status may result in account termination and potential legal action.

4. Platform Limitations

SwapMyCar does not:

• Inspect vehicles or verify their mechanical condition
• Guarantee the accuracy of mileage, service history, or MOT status
• Check for outstanding finance, insurance write-offs, or stolen status
• Act as a party to any swap transaction

5. Private Sale Nature

All vehicle swaps conducted through SwapMyCar are private transactions between individuals. As such:

• The Consumer Rights Act 2015 does not apply
• There is no 14-day "cooling off" period or right to cancel
• All swaps are "sold as seen" under UK private sale law
• SwapMyCar is not liable for vehicle condition, defects, or disputes

6. User Recommendations

We strongly recommend all users:

• Perform an independent HPI check or equivalent vehicle history report
• Conduct a thorough physical inspection of the vehicle
• Verify the V5C logbook and ensure it matches the seller's identity
• Meet in a safe, public location
• Check MOT history via the official DVSA website

7. Fees and Payments

Listing a vehicle on SwapMyCar is free. However, we charge fees for:

• Unlocking Swap-Safe Reports (£14.99 per vehicle)
• Premium listing features (pricing varies)

All fees are non-refundable unless otherwise stated.

8. Intellectual Property

All content, trademarks, and data on SwapMyCar are the property of SwapMyCar UK Ltd. Users may not reproduce, distribute, or create derivative works without our express written permission.

9. Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent activity
• Provide false information
• Abuse the platform or other users

10. Limitation of Liability

To the fullest extent permitted by law, SwapMyCar UK Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any vehicle transaction.
